Service Contract Inventories

Section 743 of Division C of the FY 2010 Consolidated Appropriations Act, P.L. 111-117 requires civilian agencies subject to the Federal Activities Inventory Reform Act of 1998 (Public Law 105-270; 31 U.S.C. 501) to prepare an annual inventory of their service contracts.

The Office of Management & Budget (OMB) issued a

• November 5, 2010 memorandum entitled "Service Contract Inventories" (PDF - 12 pages, 174 KB) that provides guidance on preparing the inventories,
  and subsequently updated this initial guidance in a
• December 19, 2011 memorandum (PDF - 4 pages, 327 KB).

Department of Homeland Security service contract inventories meet all OMB requirements on data elements and structure. The inventories include all service contract actions over $25,000 awarded in the specified fiscal year. The inventories consist of funded contract actions including contract actions made on the Department's behalf by other agencies. Similarly, the lists exclude contract actions made by the Department on another agency’s behalf with the other agency’s funding.

FAIR Act

The Federal Activities Inventory Reform Act of 1998 (Public Law 105-270), known as the FAIR Act, was enacted by Congress and requires executive agencies to make an annual accounting of government personnel, by location, function, and position, performing either commercial activities or inherently governmental activities and submit them to the Office of Management and Budget (OMB). An activity function code is used to describe the work performed by each full time employee.

Definitions of the FAIR Act Inventory function codes

The Department of Homeland Security is a major law enforcement agency with classified and non-classified but sensitive law enforcement activities. Our inventories include a great deal of information about these activities on a site-by-site basis. Classified material has been excluded from these inventories. Similarly, there is non-classified but sensitive law enforcement and US Coast Guard military that has not been included or made fully available to the public without proper advance review.

Competitive Sourcing

Under competitive sourcing, executive agencies must study some of the commercial activities performed by federal employees to determine if it is more efficient to procure such services from the private sector.

Section 647(b) of the Appropriations Act, (Public Law 108-199) establishes a government-wide reporting requirement for competitive sourcing.  Pursuant to the Section 647(b), each executive agency must annually inform Congress about its competitive sourcing efforts for the prior fiscal year.
