Defining Chemical-terrorism Vulnerability Information

In the interim final rule, the Department of Homeland Security identifies information that constitutes Chemical-terrorism Vulnerability Information to include the following:

  • Security Vulnerability Assessments (SVA);
  • Site Security Plans (SSP);
  • Documents relating to the Department's review and approval of SVAs and SSPs, including Letters of Authorization, Letters of Approval, and responses to them;
  • Written notices and other documents developed to comply with the interim final rule;
  • Alternative Security Programs;
  • Documents related to inspections and audits;
  • Notices of deficiency;
  • Records of training, exercises, and drills;
  • Incidents and security breaches;
  • Maintenance, calibration and testing of security equipment;
  • Objections and appeals;
  • Records required to be created and maintained by regulated facilities;
  • Sensitive portions of orders, notices, or letters;
  • Information developed pursuant to the Top-Screen process; and
  • Other information designated as Chemical-terrorism Vulnerability Information by the Secretary.

Such information collection shall be performed through the facility owner’s completion of the Chemical Security Assessment Tool (CSAT) or similar programs approved by Homeland Security. The Department will utilize this information for the purposes of

  • administering and executing the Chemical Facility Security program, and
  • verifying compliance with the Chemical Facility Anti-terrorism Standards.

Pursuant to Section 550 of PL 109-205, Homeland Security is authorized to employ a sensitive but unclassified (SBU) designation to identify information collected under this program.

Federal regulations, found at 6 CFR Part 27.400, authorize the Department of Homeland Security to apply the protective marking, “Chemical-terrorism Vulnerability Information (CVI)”, to this information and alerts the recipient that it is exempt from public disclosure and is afforded other safeguarding protections. The marking also informs the person in possession of  Chemical-terrorism Vulnerability Information that it must be handled according to specific procedures.
