When the Title 42 public health Order lifted at 11:59 p.m. on May 11, the United States returned to using Title 8 immigration authorities to expeditiously process and remove individuals who arrive at the U.S. border unlawfully.

DHS and State are implementing that plan within the constraints of a broken immigration system that Congress has repeatedly failed to fix, including by not acting on President Biden’s comprehensive immigration reform proposal, bipartisan legislation to protect Dreamers and farm workers, or repeated requests for additional resources.

During the first half of Fiscal Year (FY) 2023, the U.S. Department of Homeland Security (DHS) increased removals and returns to 225,483, up from 170,896 over the same period in Fiscal Year (FY) 2022. That number includes nearly 66,000 removals, 48,381 of which were conducted through U.S. Immigration and Customs Enforcement (ICE) removal flights. Those numbers are in addition to U.S. Customs and Border Protection (CBP) total southwest land border Title 42 expulsions, which reached 453,322 in that same timeframe.
