This delegation vests the authorities of the Secretary of the Department of Homeland Security in the Chief Privacy Officer and Chief Freedom of Information Act (FOIA) Officer responsibilities, to include:
- Authority over management, governance, and oversight of Component Privacy/FOIA activities;
- Approval authority over Departmental hiring of Component Privacy and FOIA Officers, including participating in identifying, recruiting, and hiring these personnel, and exercising concurrence authority for annual performance reviews; and
- Coordination authority over disclosure of records subject to FOIA/FOIA litigation.
