The Department of Homeland Security announced that it will take necessary anti-fraud and abuse measures to protect the integrity of the H-2B visa program and also make available 35,000 supplemental H-2B temporary nonagricultural worker visas for the second half of fiscal year (FY) 2020. The allocation also comes with new conditions to protect American workers, provide relief to seasonal employers who truly need it, and reduce fraud and abuse in the program.

The U.S. Department of Homeland Security implemented the Inadmissibility on Public Charge Grounds final rule. Under the final rule, DHS will look at the factors required under the law by Congress, like an alien’s age, health, family status, assets, resources, and financial status, education and skills, among others, in order to determine whether the alien is likely at any time to become a public charge. The rule now applies nationwide, including in Illinois.

The Department of Homeland Security will begin processing migrants for return to Mexico under the Migrant Protection Protocols (MPP) at the Nogales Port of Entry south of Tucson, Arizona. This brings the total number of ports of entry where MPP returns will be made to seven. Any migrants making illegal or inadmissible entry at the Southwest Border, regardless of location of entry, may be returned to Mexico through one of these locations to await their immigration court proceedings. Previously, migrants apprehended in the Tucson Sector were returned to Mexico through El Paso for processing under MPP. The expansion to the Nogales Port of Entry reflects the continued commitment by both the United States and Mexico to a program that has proven effective at reducing human smuggling across the Southwest Border.
